Khalid Sheikh Mohammed Could Walk

Elections have consequences. One consequence of voters' appalling lapse of judgment last November is that Khalid Sheikh Mohammed, the mastermind behind the Muslim atrocities of 9/11, may soon be free to plot future terror attacks at his leisure.
Mohammed and the four others — Waleed bin Attash, Ramzi Binalshibh, Mustafa Ahmad al-Hawsawi and Ali Abd al-Aziz Ali — are accused of orchestrating the attacks that killed 2,973 people on Sept. 11, 2001, and will now be tried in a courtroom down the street from the World Trade Center.
We all know they're guilty. But in a civilian circus of a trial, information gathered through means of which our liberal rulers disapprove — e.g., waterboarding — will be inadmissible. If O.J. could walk, so could K.S.M.
Maybe that's what it will take for people to understand just how insane and disgusting it was to put a leftist punk in charge of our country.
Lawmakers and victims' families expressed outrage Friday that President Obama has approved a recommendation to try self-proclaimed Sept. 11 architect Khalid Sheikh Mohammed and four other Guantanamo Bay to New York to face trial in a civilian federal court.
"These terrorists planned and executed the mass murder of thousands of innocent Americans. Treating them like common criminals is unconscionable," Sen. John Cornyn, R-Texas, said in a statement.
"This, I think, will go down as one of the worst decisions any president has ever made," said Rep. Peter King, R-N.Y.
"The only thing they are going to do is give them a stage to mock us … and this makes me sick to my stomach," said Tim Brown, a former New York City firefighter and founder of Thebravest.com, a group that is petitioning the administration not to bring terrorists to civilian courts.

Based on the rules of criminal procedure, how can we expect an "impartial jury of his peers" to be seated in such a case?
It's impossible and the most ridiculous legal decision I've seen in my entire life. This one trumps the OJ debacle by a million miles.

No special circumstances. No political dimension. No chance for the crazy-ass muslim extremists to use a military tribunal to recruit more people to their ranks. Just a simple trail, a guilty verdict, and into the general population of some supermax prison. Whaddya bet there are a few guys with nothing left to lose that might have something special for KSM when he arrives at the cellblock?
That's the best possible outcome here. Send him to a regular prison where he has to deal with honest-to-god criminally insane people who will be decidedly unhappy with him. He will get worked over constantly until he shuffles off the mortal coil.

I can appreciate the economy, in time and money, of lynching people "we know" are guilty. Problem is, that goes against every concept of liberty and justice that America stands for.

KSM and his colleagues wanted to plead GUILTY, wanted to be MARTYRED last September. These defendants admitted to it, took pride in doing it, they have NO defense. So, their lawyers will do the only thing they can: Put the US Government on trial.
Public trials of what should be military tribunals are one of the biggest ways that intelligence is outed. The people who tracked him and his minions down will be subpoenaed - what are they going to say?
If Obama had wanted to more thoroughly undermine the US Military, US Intelligence, and cause potential harm (yes, maybe a second terrorist attack on his watch), he could not have picked a better way.
Treating Al Qaeda threats and Islamist terrorism as a matter of "common criminals" is precisely what led to the 9/11 terrorist attacks. Just like ignoring all of the signs of pending jihad from Nidal Malik Hasan led to the Ft. Hood terrorist attack.

I doubt he'll walk in the end, but I also have NO doubt we'll all be subjected to an unimaginably stomach-turning brew of lectures on the evils of our way of life from these psycho-killers and their attorneys, lectures from the MSM outside the courtroom on Islam and our own intolerance, a golden opportunity that al-Jazeera and the others won't miss to get into our nightly news cycle and harangue us about this and that, and much much handwringing on cable news for many months about how conflicted we all feel about this or how we are all having a hard time getting closure about that. It will be a complete and total mockery, and it will be staggering in its disrespect and disdain for our people and way of life - all while lecturing us on how it shows we are "better than them."

You assume innocence despite KSM and buddies own(both before and after interrogation) boastful claims to have led this attack. You presume and call the Bush presidency a regime insinuating that Bush acquired power and held power by force (standard layman definition of regime). And furthermore you accuse the U.S. of torture without unequivocal proof (torture is a subjective definition written by the current power structure. Generally if it is being done to you or to those you support one tends to claim torture at much lower levels).

We all endured the 9-11 Commission and knew that the results were compromised by Jamie Gorelick's position on the Commission. She was the author and enforcer of "The Wall," which meant the wall between intelligence and law enforcement; the CIA/NSA and FBI. Regardless, the wall came tumbling down and we were safe for 8 years.
But even the compromised commission's report findings are disregarded by Team Obama. The good recommendations, and any understanding of what went wrong leading to 9-11, are being tossed. If I didn't know better, and maybe I don't, it would appear that these thugs are stacking the deck in favor of the terrorists. With the moving of the 9-11 planner and others to federal court; and bestowing them constitutional rights although not citizens, we get another hint of Team Obama's loyalties.
First of all, Hasan is an American citizen. He has constitutional rights. That's mixing apples and oranges. What Holder is doing, again, is putting the Bush administration on trial. He wants to expose the tactics used to extract information and confessions. Keep in mind that Holder fully intends to investigate/prosecute the 9-11 interrogators.
There are a lot of solid reasons for keeping terrorists out of our courts. The discovery process will destroy us. It appears that they want classified information released to benefit our enemies. Or, they want to put the prosecution in a lose-lose situation; where classified information can't be introduced into evidence so the terrorists can't be fully convicted. They might not walk, but they will likely be convicted of lesser charges than the deaths of over 3,000 citizens. And, where will they serve out their sentences? And who will they continue to influence?
Finally, step back and take a big picture view--it's Holder that's threatening to prosecute interrogators and now those they interrogated are being prosecuted by Holder. He probably intends to give them the Black Panther treatment and make this entire thing go away based on a technicality. They might end up acquitted and be sent to Hawaii or something. Have we had enough already?
Oh, yeah, see this a setting precedent. Our troops are already having to mirandize terrorists on the battlefield. They have the right to remain silent while our soldiers have no right to defend themselves against them. Our soldiers join with law enforcement and border guards in the thankless job of pursuing bad guys while trying to stay alive and out of jail for any perceived slip in procedure. And, how many new terrorists are going to fill our courts? Are we going to import them to the USA now? Are these people insane? Do they want to clog up the courts that are already creeping at 5 miles an hour. Enough of this rant. This is a terrible decision for everyone but terrorists and terrorist sympathizers like Team Obama. Liberalism is a mental disorder.

Sure, they'll all walk. Especially if we confer all the constitutional rights reserved to U.S. citizens. Just like Bill Ayers walked, they will also walk on some technicality derived from the constitution. Ayers walked because of inadmissible evidence amassed from "illegal" wire taps.
Pro-bono? Naw, more likely some federal Stimusol will somehow be directed to Holder's "former" law firm. Covington and Burling, LLP; Which, appears to be representing at least 17 Yemeni and Pakistani "clients" at Gitmo. When his platform specifically included closing Gitmo, It was just too coincidental that Obamao hand-picked Holder for that AG position.

So could KSM "walk"? If we believe in innocent until proven guilty, then he could. We can't claim anyone is getting a fair trial if we also state they are going to be found guilty.
Will KSM get a fair trail? Moussaoui and the shoe bomber were tried in the U.S. and are now in jail. Why should the trial for KSM end up differently? There's lots of evidence against him that's admissible, not the least of which are his confessions.
If we are afraid that our justice system can't deal with terrorists, then the "terror" that those people unleashed has been successful.

KSM will walk out of Federal court a free mas as sure as the sun will rise tomorrow. As I believe this is exactly what Barack Hussein and his Attorney General stooge Eric Holder want to happen.
KSM's lawyer will file a Motion to Dismiss. On the grounds KSM was denied Constitutional due process:
Denied his right to a fair and speedy trial;
Was not given his Miranda Warning,(the right to remain silent to avoid any incriminating statements and to have the right to speak with an attorney before any questioning and to have that attorney present during any and all subsequent questioning;
Was denied the right to face his accuser and to be presented with the evidence against him;
Was water-boarded "tortured" over a hundred times (which the government plainly admits doing] which is a clear violation of both the 4th and the 5th amendment.
Denied a bail hearing within a reasonable amount of time and allowed the right to a telephone call.
Any judge in any civilian court in America (municipal, state or Federal) presented with these facts concerning the treatment of a suspect. Under precedents set in both Supreme Court rulings as well in case law. The judge has no alternative but to grant the motion to dismiss the case.
