Cue the Circus Music

Scott Fenstermaker, the attorney representing Khalid Sheik Mohammed and the other 9-11 terrorists who have been gifted by the Obama administration with full Constitutional Rights just as though they were American citizens (and not foreign-national jihadists hell-bent on butchering every American in sight) has said that his clients will use the trial as a forum for denouncing American foreign policy. He also declined to state whether the thousands of people mass murdered by his clients were "innocent civilians."

Fenstermaker also expressed the hope that his client would be set free following their acquittal. It's getting tough to tell who hates America more, KSM or his legal team; Al Qaeda or the ACLU attorneys who want to help them. Three months ago, KSM and his co-conspirators were willing to plead guilty and die as martyrs for their cause. But Obama and Holder couldn't let that happen; not when there was a chance to give oppressed third-worlders a forum for airing their grievances against the USA.

By the way, Germany is sending an "observer" to the trial, to make sure no evidence provided in any way by Germany is used to convict the mass-murderers.

O'Reilly should have known that he would get no where with this man and that he'd waste an entire segment trying to get an answer out of this man.

I wonder how much the gov't is paying this man to be a representative of the terrorist? I cannot believe that even when they plead guilty and were to be executed, our Community Organizer Socialist Dictator in Chief wanted to step in and feel pity for these men. Justice will not be served and they will end up getting a private island and free enmities for life. I wonder how much of our tax dollars are going to be spent on caring for these men for life?

Just wait until the Ft. Hood terrorist goes up for trial. "Oh, he was just an insane radical Muslim that did not know that he was doing anything wrong at the time"...give me a break...

If a decent judge presides the defendants should not be able to use their disapproval of our national foreign policy as a defense to murder. The only defenses to murder are:
1. No one was killed.
2. If they were killed, someone else did it.
3. They did not die as a result of my actions.
4. Even if I killed them, it was not intentional.
5. It was self defense. They were using lethal force against me and I was justified in using lethal force against them. (This is a narrow not broad defense).
6. I'm insane and could not form the intent to murder.

US foreign policy is not relevant to any of these defenses. If OJ's trial had had a decent judge, we would not have been subjected to that goat rope. Let's hope the judiciary learned something from that debacle. And let's hope the judge is not a lefty.

BTW, no cameras are allowed in federal court. BY law.

Since the SCOTUS invented brand new rights for terrorists that enemy combatants had never had in any previous war, who is to say that a court won't decide on a more "expansive definition" of the defenses available to KSM and his cohorts? After all, the Constitution is a living document.

The real pits of all this is that KSM was going to plead guilty at a military court and would have gotten the death penalty. What he wanted.
BO comes along and at worse, effectively rescues him.

If this isn't giving aid and comfort to the enemy, we have never seen it in this country.

Obama is being incredibly stupid in ordering this trial - or perhaps not stupid, just malevolent.

That said, George W. Bush helped make this problem. These swine should have never been brought to Gitmo and treated as prisoners of war. The unimportant ones should have just been shot out of hand. As to the bigger fish, like KSM, they should have been sweated for what they knew, and then summarily tried and hanged as bandits.
