Deserter Ehren Watada May Get a Pass

Remember the sniveling deserter Ehren Watada? He volunteered for the Army after the invasion of Iraq and willingly completed officer training, but when it came time to be deployed, he refused to go, on the grounds that defending a young democracy from terrorists is unjust and illegal. This earned him hero status among the kind of people who support Barack Obama.

In more sensible times, Watada would have been promptly and deservingly shot for desertion. At least he was charged for missing movement, contempt toward officials, and conduct unbecoming an officer. But we live in a great time to be a moonbat. As reported at Ace of Spades HQ:

The case fell apart when it turned out that Watada had stipulated that he did not deploy with his unit as ordered and that he gave interviews without authorization. In the military judge's view, Watada hadn't realized the legal consequences of the stipulations, since they largely amounted to admitting the charges. The prosecution had already rested, but their case relied in large part on the stipulations which the military judge wanted to strike. The military judge decided that the best thing to do was declare a mistrial and start over.
Today, U.S. District Judge Benjamin Settle said the military could not retry Watada. Settle held that the military judge "did not exercise sound discretion" in ruling a mistrial. Accordingly, subjecting Watada to a second trial would violate his Fifth Amendment right against double jeopardy.

Although the military might appeal or file other charges, it looks like Watada's path to becoming President Obama's Secretary of Defense may be clear.

My first reation to this was much the same as Jaeson's--coward. However, having served in the military, I then realized that this (his not shipping out) was the best thing that could've happened. This man was supposed to be an officer, officers have many responsibilites including (in most cases) the burden of command. I can assure you, from personal experience, that this is a duty that real military officers do not take lightly. Had he been deployed, there is no telling what harm or danger he could've allowed to come to the men under his command.

Which country have any cowardly officer out on the parade ground before all his men, peer officers, superiors, family and even their kids and tear off his rank insignia and his unit patch and any medals he may have earned?
Then break his sword in half and throw it at his feet?

The only thing not done is that the men line up to spit in his face!

This site praises his "bravery" and commends him for doing his "duty" in refusing to fight an "illegal" war. They also call for the Army to give him an honorable discharge. How anyone could find honor in a 1stLt refusing to follow orders and abandoning his unit to whatever fate would come to them is beyond me. Not exactly officer grade qualities if you ask me. Of course, I'm a Navy guy, so what do I know.

Wasn't this guy commissioned as an Officer. That means he at least had to have a College education. I'm not understanding this "didn't understand the stipulations". What a load of crock.

I think they still can charge him with: refusing a lawfull order, desertion in time of war, and deriliction of duty.
Bust him to private, make him serve a year in the stockade, released only for 'light duty' (Cleaning toilets and picking up paper/cigarette butts), then give him a "bad conduct discharge".

Good thing this genius didn't deploy. His troops would constantly have had to remind him to point the open end of his weapon at the enemy.

This clown joined the military after 9/11, I'm sure with honorable intentions, but somewhere along the line he lost his cajones, plain and simple. So now he's cried enough and is being given a pass. What a crock. If I ever see this scum walking down the street, I'd make a point to go over and spit in his face, but what do I know, I only served 3 years in the U.S. Navy

Personally speaking, I don't think troops should have been deployed to Iraq or Afghanistan. What should have been deployed were nuclear warheads or neutron bombs to Baghdad, Tikrit, Basra, etc.

No US troops should have ever had to spill a drop of blood over Iraq or Afghanistan.

If we're already the 'Great Satan" to these Islamofascists, then we should start acting like it.

Hopefully, that is the tack we and/or Israel will take with regards to Iran.

After that?

I know. Why fight a war wholesale? If it is worth sending our fighting men and women into battle to risk their lives then it is worth sending our nuclear arsenal to do the job, IMHO.

Good point. Still, the gutless weasel volunteered for military service. If he wasn't prepared to give it his all, he shouldn't have wasted the time of everyone that had to train or deal with him.

I'm not so sure. His father is a far-left wing loon in Hawaii and they may cooked this up together for exactly this reason, faux conscientious objector crap. The federal judge is, IMHO, a complete ass as well. A mistrial doesn't result in a verdict, jerkweed. The only upside is that Watada will know in what passes for this gutless, spineless maggot's heart that that is what he is. Sort of like John Kerry, actually.
