Californian Nailed for Thought Crime

Always on the cutting edge of moonbattery, California brings us the Mother of All Frivolous Discrimination Lawsuits. Dan Bader describes his case:

The State of California Department of Fair Employment & Housing filed a discrimination suit against me on behalf of the non-profit, Fair Housing Council Corporation of Orange County (FHCOC). Without any forewarning, the FHCOC filed a formal complaint with the State in October 2006 after purportedly viewing an 8 word phrase in a rental ad I posted on Craigslist.com.
The Council alleged that the phrase violated State & Federal laws against discriminatory advertising on the basis of familial status and demanded $4,000 in damages plus 5 years of continuing landlord education to be taken through the FHCOC and at an additional expense to me. This private, HUD funded non-profit corporation proclaimed that it — the corporation — was damaged by the 8 word phrase I used in my ad. No individual complained and is the "aggrieved party" in the lawsuit. The civil lawsuit was filed by the State of California's attorney, Ralph Tsong, Esq., in OC Superior Court on Nov. 30, 2007 and is seeking "unlimited damages."
The alleged discriminatory phrase I used in the body of the rental ad for my attached 480 sq. ft. mother-in-law unit was:
"Well suited for 1 or 2 professional adults"

Authorities found this phrase unacceptable on the grounds that it could be construed to discriminate against tenants with children, or else it discriminates against young people.

We have reached the ideal condition for a totalitarian society, where any statement, no matter how benign, can be considered a thought crime. Since we all constantly transgress, there is nothing for us to do but crouch in terror, hoping the authorities don't notice our guilt-ridden existences.

I'm offended by the name "Ralph" it's just too "male" and oppressive so I will ask the state to fire his (her?) sorry ass or I will remain aggrieved and may require reparations for my years of mental slavery to "the man."

Incredible. Absolutely incredible. Welcome to the Land Of The Free.

One reason I find this interesting is that my sister's brother in law, a builder, has recently started building houses (I mean, rather than just doing alterations to existing properties). His first small development of houses have been designed as suitable for people with an elderly or infirm parent/relative in mind (based on his and his wife's experience with her infirm father), with a kind of apartment for the dependent relative and suitable facilities.

Presumably under such a law as this he couldn't even advertise his houses as they are!

It's ludicrous. It's saying an advertiser can't specify what sort of home they're renting. Some places are suitable for families, others for groups of sharing students, others for single people, and for various economic groups.

I can expect this from the "fruit and nutz" state.
When a property owner cannot describe the suitability of an apartment they are renting without getting sued... it may be time to pack up and call yourself an Idahoian, or an Arizonian, or even a Rhode Islander! What is while is a look at the stats on how many business and professional people (big tax payers) are "fleeing the State of California"!! They are tired of paying 5 X the money or more for housing and just about everything else and then getting taxed to death by the Governator.

What business is it of the government's to tell people who they can and can not rent to, anyway? Sure, landlords might discriminate irrationally against some people, but what business is that of the government? There are always other landlords who won't discriminate. These "Fair Housing Laws" only waste taxpayers dollars employing bureaucrats and provide money for bloodsucking lawyers.

It is to the point that people who own and maintain rentals are getting out of it. You cannot win. If you word your lease with specific rules (like no more than a certain number of people in a rental.) and then try to enforce it, you can be counter sued in court. The judge will side with the tennant who decided it was not fair that they could bring 20 family members into a one bedroom unit. My aunt and uncle had many rentals a few years back and sold every one of them because they kept losing money and couldn't afford to retire with that kind of thing chipping away at their retirement funds. Sad, but true.
Between fixing all the damages, tennents leaving oweing 3 months back rent, the way laws have made the eviction process long and costly and the liability that the landlord takes on... it's ends up costing the owner 9 times out of 10.

California is a great state, but we have a serious infestation of moonbats. Lefty weirdness isn't the Governator's fault; he suffers from it as much as anyone, and God knows things would be worse without him in charge. (As they were under Gray Davis. Yikes!)

I keep hoping the moonbat infestation will move to Vermont or some such place, and leave the rest of us alone. So far, no luck.

mother-in-law unit ?? Back when I lived in El Dorado County, they used to call those units "Grannie flats"! I guess you could get sued for ageism now for such a term!

Jay, I believe many of them have moved to Nevada to escape California's strangling tax rate. But there are just too many of them for you to notice a difference. (I used to live in Nevada.)

A couple of questions:

Does this mean that the increasingly-popular 55-and over communities are against the law in California?

Are landlords still able to indicate that tenants must be non-smokers? (Answer: yes...California libs hate smokers.)

Can landlords ban pets?

The Moonbats are having a field day with with Heston's death saying things like "I guess we can now pry that gun from his cold dead hands" and "I wish he had died from gunshot wounds for his refusal to support gun laws". WTF? Literally, WTF! This is, without a doubt, the STUPIDEST and MOST DANGEROUS thing I've ever read about up to this point. This is really, really, REALLY a danger to us as homeowners. You can bet your ass that if this poor guy loses, it will be cited across the country in cases not disimilar. People had best be prepared to defend their rights as landowners.

Red Leg, one of my friends in the PGR in Kentucky had a battle with his "Neighborhood Association" over the height of his flag pole! The "Hood Nazis" had a problem with people having flags, so they wrote it into the "bylaws" that the pole had to be a height that was "non-standard". Heaven forbid a regular citizen should want to fly Old Glory in their front yard! How gaudy and tacky can you be??? It seems it's not enough to dictate what color and style your mailbox has to be for some people. Maybe it's time to stock up on plenty of ammo, as we may have to fight for our basic freedoms all over again.

It appears to be a state supported campaign group doin' the perusin'. This is one of the things many people haven't really got their heads around yet about the New Fascism. It contracts out government to a myriad external agencies; pressure groups, committees, faux charities and regulatory agencies and so on, with power, patronage and money swirling between them and all mutually reinforcing. It's a very, very effective strategy.

People tend to be watching out for re-runs of the horrors of the past and thus can't quite see what's going on because what is happening is a new type of abuse, unprecedented in history. For instance communism and national socialism were characterised by particular visible effects; organised secret police forces, militarisation of society, etc. Those things aren't the strategy this time. As a result, because people aren't seeing torchlit cod-pagan processions and lots of peaked caps and banners, they don't recognise the descending tyranny for what it is.

Power isn't being concentrated in government so much as in a huge nebula of governance with unaccountable appointed agents and agencies who are nominally outside the governmental structure, and touted as "independent". Government itself is actually becoming steadily weaker and weaker as its powers are drained away; some upwards to tranzi organisations (UN, EU) and sideways to the various types of agency. Government becomes just a creature that does the bidding of the real policy makers who continue regardless of attempts at democratic change by the populace (simply put, the EPA will still be making environmental laws regardless of who happens to be your president, senator or congressman).

This is why the cultural marxism project rolls on apparently regardless of the wishes of the people, even though it has little support. The structures have been fundamentally altered over the past few decades. Until those structures can be recognised by the mass of the people and actively dismantled, there is no hope of winning back freedom.
