Disgruntled Student Takes Bad Grade to Court

Is there anything left that people won't sue over?

Brian Marquis, age 51, is pursuing Bachelor degrees at U-Mass Amherst. A teaching assistant half his age gave him a C, and Marquis didn't like it. It seems the mediocre grade violated his civil rights and inflicted "emotional distress."

Ombudsman Catharine Porter suggested he get on with what passes for his life, given that he has "no grounds for an academic grievance." But instead Marquis filed a 15-count lawsuit, which a district court judge tossed out last week. Now Marquis is considering an appeal to the First Circuit Court of Appeals.

As Porter notes:

If every student that didn't like his or her grade started to do this, we'd have to hire, I don't know, 25,000 attorneys.

That would probably put U-Mass out of operation. But at least then a few professors might come to understand what it's like for businesses trying to survive in Lawyerland.

this story reminds me of my own stupidness back in the 1990s when i think i might of had youth dementia.

i was attending a university in the south west at the same time OJ was killing his wife and going to trial.

I made an unfortunate Class schedule decision i registered for a philosophy class because i needed at least 15 credits to stay in the dorm and because all the classes I really needed to take were full at the time. also a friend of mine was taken the class and convinced me it would be cool to hang everyday around 1pm.

So it began the worst class I've ever taken in my college career.

We started with 200 people in a lecture hall, 2 weeks into the class we widdled down to 50 and it was apparent our teacher or lack there of, was some kind of dunce. But i stuck it out. in retrospect that was big mistake #1. I should of dropped the class and taken 25% money hit.

reading out of the selected book was very difficult for a 100 level class, and the teachers lack of lecture skills made it.

i can remember read and re-reading entire sections and just not getting it, "if a tree falls in the forest and nobody hears it does it make a sound." "We aren't really here its a figment of our imagination"

I knew reality was what you make it, but having over 1000 pages dedicated to retelling this fact over and over in different ways just lost my interest.

Over the course of the next 4 months our class dropped down to 4 people. 4 people sitting in a giant empty room. meeting 3 times a week for 90 minutes, with nothing to say.

Sometimes the teacher wouldn't show up for class.

we noted that on the syllabus 4 tests were suppose to be given, yet none were ever handed out.

The last week of classes all 4 of us, 3 plus my buddy that got me into this, became nervous about the final. Our teacher never reviewed anything, and barely wrote anything on the board for our notes.

I studied as best i could under the circumstance. The last day of class before the final we all came in to discover our teacher some how expected us to memorize all 1000 pages and be able to spew them at verbatum during a 60 minute final.

Well all 4 of us, ran out of the class room as the so called professor was still jabbering on, and we went right to the office of philosophy and began demanding satisfaction.

Well of course your not going to get any since like complete idiots we waited till the last minute in some vein hope we would all magically receive 'A's for simply showing up and having to endure this Crapulance.

So i studied, my friend didn't, the other 2 didn't show up for the final exam.

it was just the 2 of us. I wrote alot much like this post, and my buddy left about about 20 minutes, i was the only person to stay the full hour and i answered all the questions to the best of my abilities.

I looked the teacher in the eye, when i handed my paper in and wished her a good summer.

about a month later i received a 'D' and my friend also received a 'D' and i later learned the other 2 that didn't come to the exam received a 'D', for a long time after that i was really pissed, i studied and fell flat on my face and others were rewarded for not even trying.

There was no Karma really, I mean the teacher was eventually fired. It turned out she was actually a graduate student not a professor, the book we were told to read also turned out to be an Advanced book not for a 100 level class. i never fought the grade i just accepted it.

the only good thing that occured, was The teachers name was W. Simpson.

and for the next 2 years, we coined the term
"O.J. Killed the wrong Simpson"

I think this guy Brian Marquis is a woosey.

Really, though, I think Van hit it on the head when he said, "a teaching assistant half his age." What a blow to his ego to have some 20-something give him a C!

I could never understand why someone that age would be in college anyways...what will he do if he does get his degree? would anyone hire him in at that age for what he is majoring in? the other thing is he's wasting money on college that should be saved for retirement(unless of course he took out a loan).

Pardon my cynicism, but he probably is working on his retirement. He probably went back to school with a lawsuit in mind. He's a paralegal, after all. He had the lawsuit filed within a couple weeks of receving his grades.
